Terms of Use for Local Plumbing

1. ACCEPTANCE OF TERMS

 Welcome to Local Plumbing. These Terms of Use ("Terms") govern your access to and use of the website located at localplumbingca.com and any related pages, booking tools, and online services (collectively, the "Site"), and your engagement of services from Local Plumbing ("Local Plumbing," "we," "us," or

 "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

 2. ABOUT US AND OUR SERVICES

 Local Plumbing is a licensed residential home services company (CSLB Lic. #1091739, C16 & C36) serving the Sonoma and Marin areas of California. Through

 the Site you can learn about our plumbing, heating, sewer line, fire protection, and electrification services, request estimates, and schedule service. Any

 service we perform is also subject to the estimate, invoice, or service agreement provided to you at the time of service, which controls in the event of

 a conflict with these Terms regarding the specific work performed.

3. ELIGIBILITY

You must be at least 18 years old and able to form a binding contract to use the Site or request services. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.

4. USE OF THE SITE

You agree to use the Site only for lawful purposes. You will not: (a) use the Site in any way that violates applicable law; (b) attempt to gain unauthorized

access to the Site or its systems; (c) interfere with or disrupt the Site; (d) upload or transmit viruses or malicious code; or (e) use the Site to harass,

abuse, or harm another person. We may suspend or terminate your access at any time for conduct we believe violates these Terms.

5. BOOKING, ESTIMATES, AND SERVICE REQUESTS

Requests submitted through the Site (including through our online booking assistant or contact form) are requests only and do not constitute a confirmed

appointment until we contact you to confirm. Estimates provided are based on the information available and may change following an in-person assessment. Pricing, availability, and scheduling are subject to change.

6. USER-PROVIDED INFORMATION

When you submit information through the Site — such as your name, contact details, service address, photos, or a description of your issue — you represent

that it is accurate and that you have the right to provide it. You grant us permission to use that information to respond to your request, provide services,

and communicate with you as described in these Terms and our Privacy Policy.

7. INTELLECTUAL PROPERTY

The Site and its contents — including text, graphics, logos, images, and the Local Plumbing name and marks — are owned by or licensed to Local Plumbing and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our

prior written permission.

8. ELECTRONIC COMMUNICATIONS

By using the Site or contacting us electronically, you consent to receive communications from us electronically, including by email, telephone, and — if

you opt in — text message. We may communicate with you about your appointments, services, billing, and account. Text message consent is governed by Section 9 below.

9. MOBILE MESSAGING TERMS & CONDITIONS (SMS/MMS)

These Mobile Messaging Terms govern the text messaging program (the "Program") offered by Local Plumbing. By enrolling in or using the Program, you agree to this Section 9.

• 9.1 Program Description. The Program allows Local Plumbing to send you recurring service-related and customer care text messages, including appointment booking confirmations, appointment reminders, technician dispatch and arrival notifications, scheduling and cancellation updates, post-service follow-ups, requests to confirm booking details, and responses to your inquiries.

• 9.2 Consent / Opt-In. You opt in by providing your mobile number and agreeing to receive texts through our online booking assistant or contact form at localplumbingca.com, verbally with our staff during a phone call, or by texting our business number. By opting in, you consent to receive autodialed text messages at the mobile number you provide. Consent is not a condition of purchasing any goods or services.

• 9.3 Message Frequency. Message frequency varies based on your service requests and interactions with us.

•  9.4 Cost. Message and data rates may apply. Such charges are billed by and payable to your mobile service provider. Contact your carrier for plan details.

• 9.5 Opt-Out. You may opt out at any time by replying STOP (or QUIT, END, CANCEL, UNSUBSCRIBE, or STOPALL) to any message. After you opt out, we will send a one-time confirmation and you will receive no further messages. To rejoin, reply START.

• 9.6 Help. For help, reply HELP to any message or contact us at (415) 234-0370.

10. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any

third party. Your use of third-party services is at your own risk and subject to their terms.

11. DISCLAIMER OF WARRANTIES

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability,

fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. This Section does not

affect any warranty we expressly provide for services performed, as set out in your service agreement or invoice.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Local Plumbing and its owners, employees, and agents will not be liable for any indirect, incidental, special,

consequential, or punitive damages, or any loss of profits or data, arising out of or relating to your use of the Site. Nothing in these Terms limits liability

that cannot be limited under applicable law.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Local Plumbing from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees)

arising out of your misuse of the Site or violation of these Terms.

14. PRIVACY

Your use of the Site is also governed by our Privacy Policy, available at https://www.localplumbingca.com/privacypolicy, which is incorporated into these

Terms by reference.

15. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute relating to these Terms or the

Site will be subject to the exclusive jurisdiction of the state and federal courts located in California.

16. Changes to These Terms of Use
